Terms of Service

The agreement between you and Fireside IT LLC for using Grandma Phone.

1.Acceptance of these terms

These Terms of Service ("Terms") govern your use of Grandma Phone, a service operated by Fireside IT LLC ("Fireside IT," "we," "us," or "our"), including the grandmaphone.com website, the family-facing app, and the elder-screen device software (together, the "Service"). By creating an account, purchasing a device or support session, or using the Service in any way, you agree to these Terms. If you don't agree, don't use the Service.

If you're creating a household or inviting family members, you're representing that you have the authority to do so and that everyone you invite has agreed to these Terms as well.

2.What the Service is

Grandma Phone is a hands-free video and photo intercom system designed for an elderly or otherwise vulnerable family member. Family members call into the elder's screen; the elder answers by speaking aloud; video is only ever activated after the elder gives spoken consent to that specific call. The Service includes account and household management, a photo slideshow feature, and video/audio calling powered by a third-party provider (see Section 10).

The Service is offered in two forms: a Complete System (assembled hardware plus setup), and a DIY Kit (a guide for building your own device using hardware you purchase yourself, paired with the same account system).

3.Accounts and eligibility

You must be at least 18 years old to create an account. Each household has one or more "owner" accounts and may include additional family member accounts. Owners are responsible for the household's invite code and for who they add or invite to the household.

You're responsible for keeping your password confidential and for all activity under your account. Tell us right away if you believe your account has been compromised.

4.Fees and payment

Pricing for the Complete System, DIY support sessions, and any other paid offering is provided at the time of purchase or quote and may change going forward (changes won't apply retroactively to something you've already paid for). Paid support sessions are billed per session, not as a subscription, and are non-refundable once the session has been performed. If you believe you were charged in error, contact us and we'll work it out.

What you're paying for with a DIY Kit purchase or account is the right to use the Grandma Phone service and software — not a physical product shipped by us (see Section 5).

5.The DIY Kit specifically

If you choose the DIY path, you are buying your own hardware directly from third-party retailers, following our published guide to assemble and configure it. Fireside IT LLC:

7.Photos and video calls

Photos you upload for the elder's slideshow are stored so the Service can display them, and you retain ownership of them. You're responsible for having the right to share any photo you upload, including consent from anyone identifiable in it. You can remove photos at any time; removing a photo deletes it from active storage (recent backups may retain a copy for a limited time — see our Privacy Policy).

Video and audio calls are transmitted live through our third-party video provider (Section 10) and are not recorded or stored by Grandma Phone. The elder's screen is designed to always ask for and require spoken consent before activating video for any individual call — this is a core design commitment, not just a setting, but as with any software it can have bugs; report anything that doesn't match this behavior immediately.

8.Not an emergency service

Grandma Phone is not a medical alert system, emergency response service, or substitute for 911 or other emergency services. Do not rely on it for life-safety situations. We do not monitor calls or guarantee that any call will be answered, seen, or responded to in time for an emergency.

9.Service availability

We aim to keep the Service reliably available but do not guarantee uninterrupted or error-free operation. The Service may be unavailable due to maintenance, technical issues, issues with our third-party providers, or circumstances outside our control. We are not liable for losses arising from downtime or interruption.

10.Third-party services

Grandma Phone relies on third-party providers to operate — currently including a video calling provider and a transactional email provider. Your use of video/audio calling is also subject to that provider's own terms and practices for handling the live media stream. We select these providers carefully but are not responsible for their independent acts, outages, or policies.

11.Intellectual property

The Grandma Phone software, website, and setup guides are owned by Fireside IT LLC and protected by applicable intellectual property law. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, resell, reverse-engineer, or redistribute the software or guides without our written permission.

12.Termination

You may stop using the Service and request account deletion at any time by contacting us. We may suspend or terminate an account for violating these Terms, non-payment, or misuse that risks another user's safety or privacy. Upon termination, your right to use the Service ends; we handle data deletion as described in our Privacy Policy.

13.Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

14.Limitation of liability

To the fullest extent permitted by law, Fireside IT LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in these Terms limits liability that cannot be limited under applicable law.

15.Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll post the updated Terms here with a new effective date, and where practical, notify account owners directly. Continued use of the Service after a change means you accept the updated Terms.

16.Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Delaware.
